Terms of Service

1) Overview

CruiseHopper is a web application for exploring and chaining cruise itineraries (the "Service"). Access to and use of the Service are provided subject to these Terms of Service (the "Terms"). By accessing or using the Service, you accept these Terms.

2) Eligibility

You must be 18+ (or the age of majority in your place of residence, if higher) to use the Service. Accounts are for personal use.

3) Account & Access

Authentication is provided via email-based sign-in. You are responsible for account security; activity under your account is deemed authorized by you. Accounts may be suspended or terminated for suspected abuse or violation of these Terms.

4) License & Personal-Use Restriction

A limited, non-exclusive, revocable, non-transferable license is granted to access and use the Service solely for personal, non-commercial purposes.

Commercial use is prohibited without prior written license. This includes, without limitation, use by travel agents, tour operators, OTAs, consolidators, media outlets, price-comparison engines, research groups, data brokers, and any party using the Service to source, sell, market, or support cruise bookings for third parties. 5) Prohibited Conduct

You agree not to:

• Scrape, harvest, or extract data (including via robots, spiders, crawlers) except as explicitly permitted by a written API license;
• Copy, reproduce, mirror, frame, or commercially exploit any part of the Service;
• Benchmark, train, or fine-tune models on Service output;
• Bypass rate limits, security, or access controls; create multiple accounts to circumvent limits;
• Upload, generate, or transmit unlawful, infringing, harmful, deceptive, or abusive content;
• Reverse engineer or attempt to derive source code (except to the extent permitted by law).

6) Third‑Party Sites & No Bookings

The Service may display information from, or link to, third‑party websites and services ("Third‑Party Services"). Accuracy, availability, pricing, schedules, policies, and terms on Third‑Party Services are not guaranteed. CruiseHopper is not a travel agency, broker, or seller of travel; no bookings are taken on the Service, and no relationship with cruise lines or vendors is created by mere use of the Service. Any booking, payment, or dispute occurs solely with the relevant third party.

7) Content & Feedback

If you submit feedback, suggestions, or other materials, you grant a worldwide, perpetual, irrevocable, royalty‑free license to use such input to operate, improve, and develop the Service, with no obligation to provide attribution or compensation.

8) Availability & Changes

The Service, features, and content may be modified, suspended, or discontinued at any time without notice. Data may be cached or delayed; uninterrupted or error‑free operation is not promised.

9) Privacy

Use of the Service is also governed by the CruiseHopper Privacy Policy (as updated from time to time). By using the Service, you acknowledge the Privacy Policy.

10) Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." ALL WARRANTIES—EXPRESS, IMPLIED, OR STATUTORY—ARE DISCLAIMED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON‑INFRINGEMENT. Results, availability, pricing, and accuracy are not guaranteed.

11) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF USD $100 OR THE AMOUNTS (IF ANY) PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM. NO LIABILITY SHALL ARISE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR LOSS OF PROFITS, GOODWILL, OR DATA, EVEN IF FORESEEABLE. Some jurisdictions do not allow certain limitations; mandatory rights are not affected.

12) Indemnification

You agree to indemnify and hold harmless CruiseHopper and its service providers from claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use or misuse of the Service; (b) your breach of these Terms; or (c) your violation of laws or third‑party rights.

13) Termination

Access may be terminated or suspended at any time for any reason, including violations of these Terms. Upon termination, the license in Section 4 ends immediately. Sections that by nature should survive (e.g., 5, 6, 7, 9–16) shall survive termination.

14) Governing Law & Venue

These Terms are governed by the laws of Hungary, excluding conflict‑of‑laws rules. Courts located in Hungary shall have exclusive jurisdiction and venue over disputes, subject to mandatory consumer‑protection rights where applicable. Claims must be brought within one (1) year after the cause of action accrues.

15) Changes to Terms

These Terms may be updated from time to time. The "Last updated" date reflects the current version. Continued use of the Service after changes become effective constitutes acceptance.

16) Assignment; Severability; Waiver

Rights under these Terms may be assigned or transferred by CruiseHopper; assignment by users is not permitted without prior written consent. If any provision is found unenforceable, it shall be modified to the minimum extent necessary while the remainder remains in force. Failure to enforce a provision shall not constitute a waiver.
